MEMORANDUM OF UNDERSTANDING AMERICAN POSTAL WORKERS UNION, LOCAL #4321 AND SALISBURY, MD POST OFFICE 1. ADDITIONAL OR LONGER WASH-UP PERIODS. TO ABIDE WITH AND FOLLOW THE NATIONAL AGREEMENT. 2. THE ESTABLISHMENT OF A REGULAR WORK WEEK OF FIVE DAYS WITH EITHER FIXED OR ROTATING DAYS OFF. ALL TOURS SHALL HAVE FIXED DAYS OFF. 3. GUIDELINES FOR THE CURTAILMENT OF TERMINATION OF POSTAL OPERATIONS TO CONFORM TO ORDERS OF LOCAL AUTHORITIES OR AS LOCAL CONDITIONS WARRANT BECAUSE OF EMERGENCY CONDITIONS. A. IT IS RECOGNIZED BY BOTH PARTES THAT ON OCCASIONS EMERGENCY CONDITIONS MAY EXIST WHICH WOULD ENCOURAGE THE EMPLOYER TO CONSIDER THE CURTAILMENT OF OPERATIONS. IN CASES OF SUCH EMERGENCY CONDITIONS, THE EMPLOYER WILL, PRIOR TO MAKING A DECISION TO CURTAIL THE OPERATIONS, TAKE INTO CONSIDERATION SUCH FACTORS AS: 1. THE DEGREE OF EMERGENCY AS STATED BY AND ACTED UPON BY RESPONSIBLE GOVERNMENTAL AUTHORITIES; 2. THE REQUIREMENTS AND REACTIONS OF ITS CUSTOMERS TO THE EMERGENCY; 3. THE ACCESSIBILITY OF POSTAL OPERATIONS AND ITS CUSTOMERS TO THE EMPLOYER AND EMPLOYEES; AND 4. THE SAFETY AND HEALTH OF ITS EMPLOYEES AND ITS OBLIGATION TO ITS CUSTOMERS. B. PRIOR TO TAKING ACTION TO CURTAIL THE OPERATIONS, THE EMPLOYER WILL NOTIFY THE UNION OF ITS DECISION AND PLAN OF IMPLEMENTATION. 4. FORMULATION OF LOCAL LEAVE PROGRAM. A. FINAL DETAILS IMPLEMENTING THE VACATION PLAN WILL BE FORMULATED BY CONSULTATION BETWEEN MANAGEMENT AND UNION AS SOON AFTER JANUARY 1ST, AS PRACTICAL FOR THE FOLLOWING YEAR AND POSTED FOR THE BENEFIT OF THE EMPLOYEES. B. NO LATER THAN 30 DAYS AFTER MARCH 1ST THE LEAVE APPLICATION FOR THE CHOICE VACATION PERIOD WILL BE CONSIDERED AND APPROVED TO THE EXTENT POSSIBLE. CONSIDERATION AND APPROVAL WILL BE BASED ON THE ORDER OF SENIORITY SHOWN ON THE LIST OF EMPLOYEES CURRENT AS OF MARCH 1ST OF EACH YEAR. THE LIST WILL BE FOLLOWED AND WHENEVER A LEAVE REQUEST, IF GRANTED, WOULD EXCEED THE MAXIMUM NUMBER ALLOWED OFF THEN THAT EMPLOYEE WILL BE CONTACTED AND PERMITTED TO CHANGE THE DATE OF HIS VACATION. APPLICATIONS FOR LEAVE DURING THE CHOICE VACATION PERIOD WILL BE ACCEPTED FOR APPROVAL BY SENIORITY FROM JANUARY 1ST THROUGH MIDNIGHT, MARCH 15TH OF EACH YEAR. C. AFTER THE LEAVE APPLICATIONS HAVE BEEN CONSIDERED AND ANY NECESSARY ADJUSTMENTS HAVE BEEN MADE FOR EMPLOYEES WHO CHOOSE A DATE ALL READY FILLED, THE REMAINING OPEN DATES WLLL BE AVAILABLE ON A FIRST COME, FIRST SERVED BASIS UNTIL THE LAST WEDNESDAY IN APRIL. D. OTHER APPLICATIONS WILL BE CONSIDERED, CONSISTENT WITH THE NEEDS OF THE SERVICE. 5. THE DURATION OF THE CHOICE VACATION PERIOD. THE DURATION OF THE CHOICE VACATlON PERIOD IS THE FIRST FULL WEEK IN MAY THROUGH THE SECOND FULL WEEK IN SEPTEMBER AND THE FULL WEEK THAT INCLUDES THANKSGIVING DAY FOR CLERKS. MAY 15TH THROUGH SEPTEMBER 15TH FOR CUSTODIANS AND JUNE 15TH THROUGH SEPTEMBER 15TH FOR THE REMAINDER OF THE MAINTENANCE CRAFT. 6. THE DETERMINATION OF THE BEGINNING DAY OF AN EMPLOYEES' VACATION PERIOD. FOR THE FULL WEEKS, THE DAY THE VACATION PERIOD BEGINS WILL BE MONDAY DURING THE CHOICE VACATION PERIOD, IN UNITS OF EITHER 5 OR 10 DAYS. 7. WHETHER EMPLOYEES AT THEIR OPTION MAY REQUEST TWO SELECTIONS DURING THE CHOICE VACATION PERIOD, IN UNITS OF EITHER 5 OR 10 DAYS. THE EMPLOYEES MAY, AT HIS OPTION. REQUEST TWO SELECTIONS, DURING THE CHOICE VACATION PERIOD, IN UNITS 5 OR 10 WORKING DAYS INCLUDING HOLIDAYS, THE TOTAL NOT TO EXCEED 10 OR 15 DAYS TO WHICH HE IS ENTITLED 8. WHETHER JURY DUTY AND ATTENDANCE AT NATIONAL OR STATE CONVENTIONS SHALL BE CHARGED TO THE CHOICE VACATION PERIOD. A. JURY DUTY OR ATTENDANCE AT NATIONAL OR STATE CONVENTIONS SHALL NOT BE COUNTED AS ONE OF ANY EMPLOYEE'S OPTIONS FOR CHOICE VACATION PERIOD. B. JURY DUTY SHALL NOT BE COUNTED AS ONE OF THE NUMBER OF PERSONS ALLOWED OFF DURING TIE CHOICE VACATION PERIOD. 9. DETERMINATION OF THE MAXIMUM NUMBER OF EMPLOYEES WHO SHALL RECEIVE LEAVE EACH WEEK DURING THE CHOICE VACATION PERIOD. UNDER THE PRESENT CLERICAL ARRANGEMENT, IT IS NECESSARY TO PLACE THE CLERKS INTO SIX (6) GROUPS OR TOURS IN ORDER TO EQUITABLY GRANT ANNUAL LEAVE AND TO ASSURE ADEQUATE STAFFING AT ALL TIMES. THESE GROUPS ARE: CLERKS ASSIGNED TO SUPPORT AND CUSTOMER SERVICE FUNCTIONS CLERKS ASSIGNED TO MAIL PROCESSING - TOUR 1(0001 TO 1100). CLERKS ASSIGNED TO MAIL PROC@SSING - TOUR3 (IIOOTO2400). VOMA CFS MPOO SECRETARY DURING THE CHOICE VACATION PERIOD THERE WILL BE ALLOWED ON LEAVE THE NUMBER OF CLERKS AS FOLLOWS: A. SUPPORT AND CUSTOMER SERVICE FUNCTIONS - 15%, B. MAIL PROCESSING TOUR I - 13% - BUT NO MORE THAN 3 SPLSM OPERATORS. C. MAIL PROCESSING TOUR 3 - 15%, D. VOMA - 1. E. CFS - 12% F. MPOO - SECRETARY - 1. .5 OR MORE WILL ROUND OFF TO THE NEXT WHOLE.(EXAMPLE 1.5 = 2 PERSONS; PERCENTAGE WILL APPLY TO THE NUMBER OF PEOPLE IN A PAY STATUS ON THE TOUR SCHEDULE ON APRIL 1ST OF EACH YEAR.) THE ABOVE PROVISION SHALL NOT PROVIDE A CLERK MORE PRIME TIME ANNUAL LEAVE THAN WHAT lS PROVIDED BY ARTICLE 10, SECTION 3 OF THE NATIONAL AGREEMENT. FOR MAINTENANCE CRAFT DURING THE CHOICE VACATION PERIOD THERE SHALL BE ALLOWED ON LEAVE THE NUMBER OF MAINTENANCE PERSONS AS FOLLOWS: A. ONE MPE MECHANIC OR E. T. B. ONE CUSTODIAN. C. ONE OF THE REMAINDER OF MAINTENANCE CRAFT, FOR ALL GROUPS IN THE EVENT THERE IS AN INCREASE IN THE NUMBER OF EMPLOYEES WHEREBY MORE THAN TWO EMPLOYEES USING THE FORMULA, ARE REQUIRED OFF DURING THE CHOICE PERIOD, MANAGEMENT WILL MAKE EVERY EFFORT TO ASSURE THAT THE EMPLOYEE(S) WILL BE GIVEN THEIR GUARANTEED LEAVE DURING THE CHOICE PERIOD, 10.THE ISSUANCE OF OFFICIAL NOTICES TO EACH EMPLOYEE OF THE VACATION SCHEDULE APPROVED FOR THEM. SUPERVISORS WILL ACCEPT ONLY APPLICATION P. S. FORM 3971, FOR LEAVE IN DUPLICATE. UPON APPROVAL OR DISAPPROVAL THE COPY WILL BE RETURNED TO THE EMPLOYEE AS THEIR OFFICIAL NOTICE. 11.DETERMINATION OF THE DATE AND MEANS OF NOTIFYING EMPLOYEES OF THE BEGINNING OF THE NEW LEAVE YEAR NATIONAL AGREEMENT WILL BE FOLLOWED. 12. THE PROCEDURE FOR SUBMISSION OF APPLICATION FOR ANNUAL LEAVE DURING OTHER THAN THE CHOICE PERIOD. ANNUAL LEAVE FOR THE REMAINDER OF THE YEAR, NOT IN THE CHOICE VACATION PERIOD MAY BE APPLIED FOR NOT MORE THAN 12 MONTHS IN ADVANCE AND WILL BE GRANTED ON A DAILY FIRST COME, FLRST-SERVED BASIS ON P. S. FORM 3971, TIES TO BE BROEKEN BY SENIORITY, WITH THE MINIMUM NUMBER OFF EXCEPT FOR THE PERIOD OF DECEMBER 1ST THROUGH DECEMBER 25TH FOR CUSTOMER SERVICE CLERKS AND THE PERIOD OF DECEMBER 7TH THROUGH DECEMBER 25TH FOR OTHER CLERKS AS SHOWN BELOW: 1. CLERKS ASSIGNED TO SUPPORT AND CUSTOMER SERVICE - 10%. 2. CLERKS ASSIGNED TO MAIL PROCESSING TOUR I - 8.5 BUT NO MORE THAN 2 SPLSM OPERATORS. 3. CLERKS ASSIGNED TO MAIL PROCESSLNG TOUR 3 - 8.5%. 4. VOMA- 1. 5. CLERKS ASSIGNED TO CFS -12%. 6. MPOO SECRETARY -1 . .5 OR MORE WILL ROUND OFF TO THE NEXT WHOLE. THOSE EMPLOYEES WHO HAVE APPLIED FOR ANNUAL LEAVE AND ARE IN THE MINIMUM NUMBER ALLOWED OFF WILL BE NOTIFIED OF ACTION TAKEN WITHIN 10 DAYS OF SUBMISSION OF THEIR APPLICATION. THIS WILL INCLUDE EMPLOYEES ON MILITARY LEAVE, EXCEPT IN A CASE OF MILITARY ACTIVATION DUE TO NATIONAL EMERGENCY, AND UNION BUSINESS. IN THE EVENT OF HEAVY INCIDENT OF ILLNESS OR OTHER EMERGENCY CONDITIONS IT MAY BE NECESSARY TO RESTRICT THE GRANTING OF ANNUAL LEAVE FOR THE MAINTENANCE CRAFT DURLNG THE OTHER THAN PRIME VACATION PERIOD THERE WILL BE ALLOWED ON ANNUAL LEAVE THE FOLLOWLNG: 1. ONE M. P. E. MECHANIC OR E. T. 2. ONE CUSTODIAN. 3. ONE OF THE REMAINDER OF THE MAINTENANCE CRAFT. 13. THE METHOD OF SELECTING EMPLOYEES TO WORK ON A HOLIDAY IS AS FOLLOWS: ALL CASUAL AND PART-TIME FLEXIBLE IN ACCORDANCE WITH THE NATIONAL AGREEMENT. THOSE DESIRING TO WORK ON THEIR HOLIDAY OR DESIGNATED HOLIDAY WILL BE SELECTED BY TOUR IN THE FOLLOWING ORDER: 1. ON HOLIDAY DESIRED LIST, VOLUNTEERS BY SENIORITY OTHER THAN NONSCHEDULED EMPLOYEES. 2. NON-VOLUNTEERS BY REVERSE SENIORITY OTHER THAN NON-SCHEDULED EMPLOYEES. 14. WHETHER "OVERTIME DESIRED" LISTS IN ARTICLE VIII SHALL BE BY SECTION AND/OR TOUR. OVERTIME DESIRED LIST WILL BE POSTED INSTALLATION WIDE BY SECTION AND/OR TOUR. CLERK BY SECTION AND/OR TOUR. MAINTENANCE WILL BE POSTED BY TOUR. AN OVERTIME DESIRED LIST IN THE MAINTENANCE CRAFT SHALL BE ESTABLISHED FOR EACH OCCUPATIONAL SPECIALIZATION SHOWING GRADE LEVEL OCCUPATIONAL GROUP AND SPECIAL QUALIFICATIONS WHERE NECESSARY. 15. THE NUMBER OF LIGHT DUTY ASSIGNMENTS WITHIN EACH CRAFT OR OCCUPATIONAL GROUP TO BE RESERVED FOR TEMPORARY OR PERMANENT LIGHTDUTY ASSIGNMENT. NO CHANGE FROM THE PRESENT PRACTICE OF ABIDING BY THE NATIONAL AGREEMENT. 16. THE METHOD TO BE USED IN RESERVING LIGHT-DUTY ASSIGNMENTS SO THAT NO REGULARLY ASSIGNED MEMBER OF THE REGULAR WORK FORCE WILL BE ADVERSELY AFFECTED. NO CHANGE FROM THE PRESENT PRACTICE TO ABIDING BY THE NATIONAL AGREEMENT. 17. THE IDENTIFICATION OF ASSIGNMENTS THAT ARE TO BE CONSIDERED LIGHTDUTY WITEHN EACH CRAFT REPRESENTED IN THE OFFICE. NO CHANGE FROM THE PRESENT PRACTICE OF ABIDING BY THE NATIONAL AGREEMENT 18. THE IDENTIFICATION OF ASSIGNMENTS COMPRISING A SECTION WHEN IT IS PROPOSED TO REASSIGN WITEHN AN INSTALLATION EMPLOYEES EXCESS TO THE NEEDS OF A SECTION. NO CHANGE FROM THE PRESENT PRACTICE OF ABIDING BY THE NATIONAL AGREEMENT. 19. THE ASSIGNMENT OF EMPLOYEE PARKING SPACES. MANAGEMENT WILL MAKE EVERY EFFORT TO KEEP DESIGNATED EMPLOYEE PARKING SPACES OPEN FOR OUR EMPLOYEES. 20. THE DETERMINATION AS TO WHETHER ANNUAL LEAVE TO ATTEND UNION ACTIVITIES REQUESTED PRIOR TO DETERMINATION OF THE CHOICE VACATION SCHEDULE IS TO BE PART OF THE TOTAL CHOICE VACATION PLAN. EMPLOYEES ATTENDING UNION ACTIVITIES MUST BE CONSIDERED IN THE CHOICE VACATION PLAN, EXCEPT ONE EMPLOYEE IN THE INSTALLATION MAY BE ALLOWED TO ATTEND UNION ACTIVITIES WITHOUT REGARD FOR THE MAXIMUM ALLOWED ON LEAVE ON HIS TOUR. 21. THOSE OTHER ITEMS WHICH ARE SUBJECT TO LOCAL NEGOTIATIONS AS PROVIDED IN THE CRAFT PROVISIONS OF THIS AGREEMENT. A. COPY OF UPDATED SENIORITY LIST. 1. FOR THE CLERK CRAFT, THE INSTALLATION HEAD SHALL POST AND FURNISH A COPY OF THE UPDATED SENIORITY LIST ON A SEMI-ANNUAL BASIS. AN UPDATED WORK COPY WILL BE AVAILABLE UPON REQUEST. 2. FOR THE MAINTENANCE CRAFT A CURRENT SENIORITY LIST SHALL BE POSTED. A COPY OF AN UPDATED SENIORITY LIST SHALL BE FURNISHED QUARTERLY TO THE LOCAL UNION. FOR EACH EMPLOYEE IT SHALL SHOW: SERVICE SENIORITY AND SENIORITY FOR PREFERRED ASSIGNMENTS. B. COPY OF UPDATED SENIORITY LIST FOR PART-TIME REGULARS. 1. THE NATIONAL AGREEMENT WILL BE FOLLOWED. C. SUFFICIENT CHANGE OF DUTIES TO CAUSE REPOSTING AN ASSIGNMENT. 1. FOR THE CLERK AND MAINTENANCE CRAFT, IF AN ASSIGNMENT IS CHANGED FROM THE ORIGINAL POSTING WHICH CAUSES AN EMPLOYEE TO PERFORM MORE THAN 4 HOURS OF HIS/HER WORK. PER DAY. IN A DIFFERENT OCCUPATIONAL CODE, KEY POSITION OR STANDARD POSITION FOR A PERIOD OF THIRTY (30) CONSECUTIVE DAYS, OR MORE THAN 120 DAYS IN A CALENDAR YEAR, THAT ASSIGNMENT SHALL BE REPOSTED. D. SUFFICIENT CHANGE IN STARTING TIME TO CAUSE AN ASSIGNMENT TO BE REPOSTED 1. FOR THE CLERK CRAFT, A JOB WILL BE REPOSTED IF THERE lS A CHANGE IN STARTING TIME OF MORE THAN 1 HOUR. 2. FOR THE MAINTENANCE CRAFT A JOB WILL BE REPOSTED IF THERE IS A CHANGE IN STARTING TIME OF 2 OR MORE HOURS. E. APPLICATION TO CUMULATIVE CHANGES IN STARTING TIME. 1. THE NATIONAL AGREEMENT WILL BE FOLLOWED. F. INCUMBENT'S OPTION OF ACCEPTING NEW STARTING TIME. 1. FOR THE CLERK CRAFT, THE INCCUMBENT SHALL NOT HAVE THE OPTION OF ACCEPTING THE NEW STARTING TIME. 2. FOR THE MAINTENANCE CRAFT THE NATIONAL AGREEMENT WILL BE FOLLOWED. G. LENGTH OF POSTING TIME FOR ASSIGNMENTS WILL BE 7 DAYS. 1. FOR THE CLERK CRAFT, THE POSTING TIME FOR ASSIGNMENTS WILL BE 7 DAYS. 2. FOR THE MAINTENANCE CRAFT, THE NATIONAL AGREEMENT WILL BE FOLLOWED. H. SHORTER PERIOD FOR PLACEMENT IN THE ASSIGNMENT. 1. FOR THE CLERK AND MAINTENANCE CRAFT, THE NATIONAL AGREEMENT WILL BE FOLLOWED. 22. LOCAL IMPLEMENTATION OF THIS AGREEMENT RELATING TO SENIORITY, REASSIGNMENTS AND POSTING. COVERED IN ITEM 21 AEOVE.
